DISCOMS MOVE SC AGAINST DELHI GOVT.

Delhi government is building its case for cancellation of the licence of BSES discoms, the two firms are preparing to fight it out as they approached SC.

Reliance-backed BSES Yamuna and BSES Rajdhani have sought legal advice on cancellation of their licences and stated that would be "arbitrary" and "illegal". Chief minister Arvind Kejriwal, on the other hand, has written to LG Najeeb Jung on the matter.

Kejriwal's government on Monday asked DERC to start proceedings for suspension of licence of BSES Yamuna and BSES Rajdhani if Delhi faced long blackouts from February 11 following energy supply regulation from NTPC. The recommendation to DERC was forwarded to the LG's office by Kejriwal on Tuesday.

"The likely failure of the three discoms to supply power to consumers of Delhi for long hours in a day, due to their financial difficulties, resulting in extensive blackouts, is clearly not acceptable. Under the Electricity Act, 2003, DERC is required to take care of the financials of the discoms through adequate tariffs. It is presumed that this has been done. If the discoms still claim inability to supply power due to their financial difficulties, there may not be any alternative with DERC but to suspend/revoke their licences and take over management of the companies. I am bringing this serious matter to your notice as the government may itself have to step in at some stage to control the ugly situation," the letter penned by the CM to the LG stated.
